Please read these terms carefully before ordering any products through the website, as your use of the website and purchase of any products offered is subject to these terms. By ordering products via the website (whether now or in the future) or continuing to use the website, you agree to be bound by these terms.

We reserve the right to change these terms from time to time by changing them on this page. We advise you to print a copy of these for future reference. These terms are subject to change without any prior notice. Refer to the date at the top of this page.
Use of your personal information submitted via the Website is governed by our Privacy Policy.

For the avoidance of doubt, please note that references to "Website" in these Website Terms include any current or future version of our website and and any mobile application through which you access our website or services, in each case whether accessed through any current or future platform or device.

This Website may be accessed throughout New Zealand and overseas. Braaihut makes no representations or warranties that the content of this web site complies with the laws (including intellectual property laws) of any country outside New Zealand. If you access this website from outside New Zealand, you do so on your own responsibility and are responsible for ensuring compliance with all laws in the place where you are located.

You may access some areas of the Website without making an Order. Most areas of the Website are open to everyone.

When you use the Website you will provide us with personal information such as your name, email address, telephone number, credit or debit card information and address. You must ensure that this information is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy.

Acceptance of terms:
By accessing any part of the Website, you indicate that you accept these terms. If you do not accept these terms, you should leave the website immediately, and you will not be able to order any products through the website.

You are responsible for making all arrangements necessary for you to have access to the website. You are also responsible for ensuring that all persons who access the website through your internet connection or any internet enable device of your ownership are aware of these website terms and that they comply with them.
About Your Status:
Capacity and age:
By placing an order through the website, you warrant that you are legally capable of entering into binding contracts; and you are at least 18 years old.
You acknowledge and agree that if you have a specific food allergy or intolerance, you will contact the Restaurant directly to check that the food is suitable for you, before placing your order directly with them.
Braaihut supports the safe and responsible consumption of therefore you acknowledge and agree that it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Orders containing alcohol can not be accepted from or on behalf of persons under the age of 18. In the event that you place an order for alcohol, you will be required to provide your date of birth and be required by the restaurant to show ID on delivery or pick up.

Online Ordering System Disclaimer.
The Online Ordering System Braaihut uses is governed by the "Wix Restaurants App" Terms of Service and Privacy Policy, which are in addition to the Terms and Conditions and Privacy Policy set forth by Braaihut.
Compiling your Order:
Once you select the products you wish to order from the menu and have provided other required information, you will be given the opportunity to submit your Order by clicking or selecting the "Order Now", "checkout" or similar button. It is important that you check all the information that you enter is correct and where necessary correct any errors before clicking or selecting this button; once you do so we will process your order and errors cannot be corrected.

Minimum Order Amount (Delivery Only):
Where a minimum order amount in place, you may not place an order with us until the value of your order equals or exceeds that amount. The minimum order amount must be met after applying any discounts or specials that reduce the total order amount.

Amending or cancelling your Order:
Once you submit your Order and your payment has been authorised, you will not be entitled to change or cancel your Order online. If you wish to change or cancel your order, you may contact us directly to communicate your requests. However, there is no guarantee that we will agree to your requests as we may have already started to process your order.

Payment authorisation:
Where any payment you make is not authorised, your order will not be processed by or communicated to the restaurant. All payments are processed through online payment gateway provider, Stripe (

Processing your Order and Restaurant rejections:
On receipt of your order, we will begin processing it and will notify you by email that your order has been received and is being processed. Any confirmation page that you may see on the website and any order confirmation e-mail that you may receive each indicates that your order has been received and is being processed by us, and does not necessarily mean that your order has been accepted. Braaihut has the discretion to reject orders at any time because they are too busy, due to weather conditions or for any other reason. We aim to process all incoming orders however we will communicate any rejection promptly and will notify you by email or SMS as soon as reasonably practicable, provided that you have given us your mobile telephone number and or email address.

Delivery of your Order:
Estimated times for deliveries and collections are provided are only estimates. We do not guarantee that orders will be delivered on time or will be available for collection within the estimated times.

Taxes and delivery costs:
Prices for individual menu items are quoted on the website in New Zealand dollars. These prices include any applicable taxes but exclude delivery costs (if you opt for delivery instead of collection) and any online payment administration charge imposed by Braaihut (if you pay for your Order online). These will be added to the total amount due where applicable.

Incorrect pricing:
This website contains a large number of items and it is possible that some of the items may include incorrect prices. The products will be sold for the displayed price even if the correct price for an order is higher than the price stated on the website.

Payment methods:
Payment for Orders must be made by an accepted credit or debit card through the website or in cash to Braaihut at the point of delivery to you. Braaihut does not accept cash for delivery orders.

If you pay by credit or debit card, you may be required to show the card to a representative of Braaihut (cashier, delivery driver or other employee or manager) at the time of delivery as proof of identification and so that they can check that the card conforms with the receipt data for the order. Please note that from time to time there may be delays with the processing of card payments and transactions; this may result in delays in sums being deducted from your bank account or charged to your credit or debit card.

Rejected Orders:
Once you have submitted an Order that you are paying for by credit or debit card and your payment has been authorised, you will be charged the full amount of your order. If your order is subsequently rejected by Braaihut and payment has been received the amount of the order will be refunded less any processing charges incurred by the payment provider. Upon any other cancellation your bank or card issuer will refund the relevant amount. Refunds may take between 5 to 10 working days (or longer, depending on your bank or card issuer). You acknowledge and agree that neither we nor Braaihuht will be responsible or liable to you in relation to this delay by our chosen payment provider (Stripe), your bank or card issuer in the release of funds back into your account.

Questions about your Order:
If your Order is taking longer than expected or you have any other problems with your order, you should contact the Braaihut Restaurant at which the order was placed directly.
Changing or cancelling your Order:
If you wish to change or cancel your order after it has been submitted and payment has been authorised, you may contact the Braaihut Restaurant to communicate your requests. However, there is no guarantee that we will be able to agree to your requests as we may have already started to process your order.

Complaints or feedback:
In the event that you would like to express your opinion on the quality of any products or the service provided by Braaihut, please consider providing feedback in the form of ratings, comments and reviews through our email ( or social media page. The reviews are an important part of our quality control process. Any ratings, comments and reviews that are deemed inappropriate and/or offensive by Braaihut will be removed.

If you are dissatisfied with the quality of any products or the service provided by a Braaihut and wish to seek a refund, a proportionate price reduction or any other compensation, you should contact Braaihut directly to lodge your complaint and follow our complaint procedures. Complaints must be lodged within 24 hours of placing your order otherwise no compensation will be provided. In the event the customer is not satisfied with a product of their customisation (including but not limited to their choice of Peri - Peri basting, addition of extras etc.) then no compensation will be given. We are not liable for any wrongly chosen options made by the customer during their order.

Braaihut does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and expressly disclaims any and all liability in connection with User Submissions. To the maximum extent permitted by law, we will not be liable to you for any loss or damage (whether direct, indirect or consequential) howsoever caused, nor will we be in default under these Terms & Conditions of Use, for failure to observe or perform any of our obligations under these Terms and Conditions of Use for any reason or cause except if caused by our gross negligence. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with this paragraph but allows a limitation of a certain maximum extent then our liability is limited to that extent.

Subject to law, we will not be liable for any costs, fees, claims, damages, charges whatsoever, including medical and dental costs, if a customer has any adverse reaction (including dental damage) to a product sold through Braaihut stores.

We do not give any undertaking that the Products ordered through the Website will be of satisfactory quality or suitable for your purpose and we disclaim any such warranties.

What Information we collect
We collect information necessary for us to process your order, process a refund of your order, register you for an account or provide you with other services and/or the assistance you have requested. Where practicable, we will give you the option of interacting with us anonymously.

The personal information which we collect from you and hold ("Information") includes information like your first and last name, delivery address (for delivery orders), telephone and mobile number(s), email address, details of your order, IP address and credit card details. In respect of your credit card details we only hold some information, as detailed further below. If required, we may request your bank details in order to process a refund of your order.
When you place an order with us online, we collect additional Information from you such as:
  1. Your IP address as part of your order;
  2. Your menu preferences and previous order information;
  3. Any delivery instructions or comments;
  4. Special meal requests
  5. Credit card name and number (Shown on request to a representative of Braaihut on order pick up or delivery to confirm correct card used for purchase and verify purchaser)
We may also collect your smart device ID and use your smart device’s location services (with your consent).

How do we collect Information?
We collect your Information in various ways, including when you:
  1. Visit any of our websites,
  2. When you "Like" our Facebook page or participate in any surveys, promotions and competitions through our Facebook page;
  3. Place an order via online ordering (whether on our website itself or in an application);
  4. Interact or follow our social media pages/profiles like Google+, Twitter, Facebook and Instagram;
  5. Enter into a competition or promotion through any medium;
  6. Participate in a survey;
  7. Participate in focus groups, polling and market research activities;

External Account (Facebook, Google etc.)
If you chose to register, create or log in to a Online Ordering account using an existing Facebook, Google or other “External Account Provider”, you are providing Braaihut with permission to obtain your personal information via the External Account Provider. The information that we obtain from the External Account Provider will be confirmed by the External Account Provider during the account creation process. Please review the External Account Provider’s privacy policy for further information about the information they hold and their information sharing practices.
Please note that after completing this process, your Braaihut Online Ordering account will be linked with your External Account. Your Braaihut Online Ordering Account will be accessible so long as your External Account remains active.

How do we use your Information?
We use your Information for a variety of purposes including for processing orders, providing our products and/or services to you and for any other purpose for which it was provided to us, or other related purposes and as permitted or required by law.  Such purposes include, but are not limited, to the following:

  2. Providing you with the assistance, products and/or services you have requested (this includes services and functions on a downloaded Braaihut application for a smart device);
  3. To create an Online Ordering account;
  4. Processing any orders you place with us (including displaying your order name and order status on screen in store);

  6. Determining the number of visitors to our websites and conducting reviews of our websites;
  7. Judging competitions, fulfilling prizes, awards and purchases;

Sometimes we receive data from our affiliates, customers and other third parties that helps us (or them) understand our customer’s online, ordering and purchasing activity, and generally make Braaihut a better experience for our customer.

We may also put together data from the information we already have about a customer so we can offer and suggest a variety of products, deals or offers and features to our customer, or customize the ordering experience for the customer.

Payment details
Braaihut and its franchisees do not store any credit card details for in-store orders.

Internet orders can be paid by cash in store or debit cards, or a valid credit card (which must be presented upon receipt of your order). Your credit card details are required to process payment on the internet order system however the full details are not saved once the order is processed. The credit card details we hold are: the name on the card, expiry date and the masked version of the credit card (ie first 6 digits and last 4 digits).

If you are a registered member of the online ordering system, you may have the ability to save your preferred payment method. You will be able to update this at any time by logging in to your registered account. We reiterate that your full payment details are not stored in your registered account, but rather with our partner (PCI compliant) payment gateway provider:

Third Party disclosure of your Information
Where appropriate, Braaihut and its franchisees will share your Information between themselves and with other third parties, including:
  1. To meet the purpose for which it was submitted to us or them;
    Oour related entities, suppliers and third parties who provide services to us or on our behalf or provide a service to you (for example third parties processing your online payments, third parties providing analyses of customer ordering, IT and cloud storage service providers and processors, third party suppliers providing our SMS service and mailing houses and third parties operating certain features available from our website;
  2. Entities which you have expressly allowed us to disclose your Information to;
  3. Any entities that we or our franchisees are required or permitted by law to disclose your Information to;
  4. If your personal Information is collected in connection with a joint promoter or service provider, to that joint promoter or service provider for marketing and research purposes;

If you use a credit card to place an order via our website, mobile site or app, your details will be passed on to our credit card processor who will receive your credit card details for such orders. Presently Stripe provide this service. Stripe is a secure internet payment gateway that secure your credit card number during transmission. See

If you place an order online and express interest in certain third party offers, products or services, we may provide and share your Information with the providers of those third party offers including external creative agencies, advertising and marketing companies and third party suppliers of goods and services so they can contact you directly to advertise and market their goods and services to you and to personalise the advertising and promotional material you receive from us and them;
  7. We may share Information with agents, affiliates or service providers who act for or on behalf of us in connection with our business, or for further processing in accordance with the purpose(s) for which the Information was originally collected; and
  8. Any other third parties notified to you at the time of collecting your Information or after the collection of your Information.

Where we disclose your Information to our affiliates, your personal Information will be collected, used, held and disclosed by them in accordance with their privacy policy.

Access, accuracy and security
We will take reasonable steps to ensure that your Information that we collect and hold is accurate, complete and up-to-date. However, we rely on you to advise us of any changes to your Information to help us maintain accurate, complete and up-to-date information. A Cookie is a piece of information that our web server may send to your machine when you visit one of our websites.
